The FDA initially banned Juul products in June 2022 due to a rapid increase in vaping among teenagers, and claimed that the company did not meet public health standards required by law. However, the agency stated that the reversal of the ban is not an approval but it merely means that the products are back under agency review. To date, the FDA has only approved 23 E-cigarettes and devices made by three companies, including Logic Technology Development, NJOY and R.J. Reynolds Vapor Company.

The Food and Drug Administration last week reversed a ban on Juul, one of the most popular E-cigarette companies here in the U.S.

The FDA initially banned Juul products back in June of 2022 when the U.S. saw a rapid rise in vaping among teenagers and young adults. The agency claimed the company did not include “sufficient evidence” to show the marketing of the product met public health standards required by law.

Juul was not the only vape product on the market at the time, but it was a big part of the crisis, partly because of its colorful packaging and appealing flavors like mango and cucumber.

According to the CDC, nearly 30% of high school students reported using E-cigarettes in 2019.

The agency stressed that the reversal of the ban is not an approval, it just means that the products are back under agency review.

It is also important to mention that some Juul products remained on the shelves while the company appealed the FDA’s decision.

The FDA has regulated the manufacturing, distribution and marketing of tobacco products since the Tobacco Control Act was passed in 2009. In 2016, however, a rule was passed that expanded the FDA’s authority to include all Electronic Nicotine Delivery Systems (ENDS) in addition to cigarettes, smokeless tobacco and the other products the agency was already regulating.

The FDA now has legal authority to regulate any tobacco product containing nicotine from any source, including synthetic nicotine.

To date, the FDA has only authorized 23 E-cigarette products and devices made by three companies: Logic Technology Development, NJOY, and R.J. Reynolds Vapor Company.

All of the authorized products have a few things in common: none are flavored, none are disposable or single-use and none have been authorized as moderate-risk tobacco products.

Additionally, just because these products have FDA approval, it does not mean they are safe or approved to use, rather it means that the manufacturer complied with the legal requirements to distribute and market its products.

Several E-cigarette companies claim their products can help an individual quit smoking cigarettes but while they may help transition away from smoking cigarettes, the FDA has not approved any of them as smoking cessation devices.
